If he has the money, you can seek child support and alimony. You should give temporary custody to your parents, in writing.

Unless you are very confident that he won't dispute jurisdiction, retain an attorney that practices in the County where you both last resided as husband and wife. While you can seek child support, and possibly alimony, without filing a divorce, if the marriage is over, you should file for divorce. To do otherwise would needlessly force you to incur substantial duplicative attorney fees and costs. I will gladly discuss the specifics of your case over the phone. Call my Palm Harbor office first thing in the morning. Until the Court gets involved, legally there is nothing stopping him from grabbing the kids. I also have a Tampa location.

If he is the primary wage earner then you have a claim for alimony, support, and full custody.

Use of a lawyer is recommended.
