Hurricane Damage by Neighbor Negligence

Just before Hurricane Wilma my next door neighbor placed a large sheet of concrete board over new brick pavers on his patio to prevent the rain from washing them out. It was just laid on top with no anchoring. During the hurricane the winds lifted this board and blew it into my pool screen enclosure causing it to be destroyed. The pool screen will be at least $20,000 to replace and my insurance deductible will liklely be $6000. I saw the event happen, have pictures, and have the board. Does this sound like neighbor negligence and if yes, under FL law or court decisions would I be likely to recover my deductible from my neighbor (the neighbor is a contractor building a spec home for sale). Thanks for any information.
