Legal Question in Civil Litigation in Florida

Neighbors new load and irritating AC unit

Hi.

My next door neighbor is wall to wall to my units living room. This summer, *June 2008, they installed all new ducting, a new more powerfull airhandler and a drainage pump for there Central AC unit

The problem for me,now, is that there new set up is right up against my living room wall and ceiling and is creating a big irritating noise in *my ceiling and wall.

I notified the owner and the contractor that did the AC work, as soon as there new unit was turned on and the profund noise was noticed by me. They both told me that they will see what they can do to elviate the noise. The contractor has done nothing and the unit owner lives out of state in New Jersey. I was told by our city building manager that I should let our Condo. Associations Board of Directors handle this.

In our annual Condo. meeting on 12.03/08 (six months after the fact) I was told that the BoD has done ALL they can do with out any satisfactorly responce and for me to get some legal help.

Please, can you give me some advice on this. What can I do to get them to get this noise out of my unit.

It is taking away any possibility for me to sell my unit!

Thank you

Have the noise level measured by an engineer who can testify. A nuisance lawsuit against the owner is your next step
