Re: waiting on residence

You should retain an immigration lawyer. Also, was your first marriage "legitimate"?

Re: waiting on residence

If your first marriage was a sham (that is, entered for the purpose of obtaining permanent residency), then you definitely should be concerned. But, even if your first marriage was legitimate, the USCIS can make your life very difficult because your first marriage may appear to be a sham. If you entered a marriage for the purpose of obtaining immigration benefits, then you can be removed (that is, deported) on that basis. Whether the marriage was a sham or legitimate, you should always retain an immigration attorney to complete the paperwork and attend the interview. The USCIS has been much less forgiving and more skeptical since 9/11, which has made processing more difficult for everyone, and the need for an attorney that much greater. There are non-profit agencies that provide low cost attorneys in some Florida cities if you cannot afford a regular attorney. Good luck with your situation.
