Car Damage aquired at friend's home

My car was parked in a friend's driveway and left there while we went shopping. When we had returned, limbs from a 100 ft Pine Tree had fallen on the car and cause major dents and scratches which resulted in $648. worth of damage. Should my friend's home owners insurance cover the damages that I received from her home, or is this a small claims court case?

I suggest you submit the claim to your friends homeowners company. They will prabably pay without difficulty but if they don't you can file in Small Claims yourself. Your friend will understand that is what insurance is for.

This is not a big deal. It certainly shouldn't impact your friendship. Your friend's homeowner's policy should pay. That is why people have insurance. If for whatever reason they refuse, you can file a claim with your own automobile insurer (assuming you have comp. coverage). It may not be worth reporting if you have a high deductible.

Worse case scenario, file a small claims suit.

You should schedule a formal consultation with a lawyer. A good means of obtaining an attorney referral is by contacting your State's bar association or your local county bar association. They probably have a web site and charge a nominal fee for the referral. Most attorneys either provide a free initial consultation, or charge a nominal fee.

hAVE YOUR FRIEND REPORT IT TO HER HOME-OWNERS carrier first. Usually they exclude damage to vehicles, but it's worth a try. Otherwise, it sounds like a claim under the comprehensive coverage of your auto policy. In order to prevail in small claims, you must prove thet the accident was caused by the negligence of another person
