car damage estimates for those without insurance and paying for other party hit

Our son was driving without insurance on a truck that we had co-signed on. He rear ended a van and the woman has given us 3 estimates on her car. We are paying out of pocket as son did not keep insurance up. Can we legally take the lowest estimate to get this woman's car fixed? One estimate was 3700.00 and the other two were 2100.00 and 2300.00. She wants to do the 3700.00 estimate. What are our rights? Son's insurance was cancelled on Mar 10 and the accident was on Mar 19.
