Liability and Baby Sitters

I am considering using a neighbor (18 year old college student)to baby sit for my two young children. This person will need to travel by car to pick up the kids from school. The parents of this neighbor want us to sign a document removeing any liability from the sitter in case of an accident or any other problem. Is this legal? What if anything should be drawn up for liability in a situation like this?

I would not sign anything. In fact I would request that she give you a copy of her insurance policy to make sure that she is insured. Additionally, if the children are ever going to be in their home I would also ask for a copy of their home owners policy. If they ever got into an accident and she was at fault you would not want to be prohibited from compensation for medical bills and pain and suffering. She may say that she is only trying to protect her family from any lawsuits, but that is what insurance is for. If she is insists I would find another babysitter. It just isn't worth it to sign away your rights.
