Life insurance and the ''wife''

My fiance left me as his primary and only beneficiary of his life insurance policy. He passed and now his wife he has been seperated from is contesting it with the company because she wants the entire sum. There is a child involved, but he is not in school and doesnt fit for any educational benefits. Will she succeed in changing his wishes?

Possibly. You haven't provided any information as to the initial designated beneficiary, whether there was a change in beneficiary, and if so, when, how, and under what circumstances, i.e. are there allegations of fraud or undue influence, and the cause of death, i.e. accidental versus the result of a debilitating illness where mental capacity may be an issue if there was a change in beneficiary during the illness. All of these factors could effect the outcome of a benefits claim. Also as a practical matter, your claim may be prejudiced by the fact that you were the decendant's "fiance" while he was married with a dependent child.
