Legal Question in Insurance Law in Florida

I live In NW Florida. As an intended plaintiff suing a Miami auto insurance company for property damages that accrued in Miami can I seek travel expense in filing and attending a small claims action? The at-fault insurance company has offered 1/3 of the lowest estimated damages and I suspect that is due to my residing so far away from the accident location. Travel expenses to file and attend court would excede my expected recoverable amount.

You wont get travel expenses as part of the reimbursements in your case. IF the insurance company does business in Florida, sue them in your locale. There is jurisdiction there. The accident location is one the forum choices but not the only one. Seek some actual legal guidance with your paperwork.

Forgot to add that the insurance company is not the party to the case it is the driver of the at fault vehicle. You have to see them unless you have some assignment of the claims the at fault driver would have against their own company. I would sue in your local court and take it from there.
