Legal Question in Insurance Law in Florida

If I pay my own medical insurance policy every month out of my pocket and i was injured in a slip and fall accident. My insurance pays the hospital. Do I pay the insurance for paying the hospital ? or is that hospital bill suppose to be paid by the insurance? I fell in the restaraunt.

Your insurance company should pay your medical bills but if they find out that you are pursing a claim against the restaurant then they may expect repayment from you.

The good news is that if they pay the bills then you would be able them back at their pre-negotiated, lower, rates. Also, you may be able to negotiate even further with your insurance company to pay them only a portion of their lien.

This stuff can get tricky and it is often where attorneys earn their fees.

The health insurance company pays the bills and then they have a lien for what they paid on any recovery you make. They will negotiate the lien as a result of the claim and the recovery.
