Legal Question in Employment Law in Florida

In May of 2009 I lost my job because my position was eliminated due to the economy. I was assured it has nothing to do with job performance. Now 10 months later they have hired another person in my former position. I was never contacted about the position. Other than being very unethical, is there anything legal that can be done?

Generally, no. Employers can lay off due to a slow economy and rehire for the position when things pick up, and they don't have to come back to you and offer you back your old job. There really wouldn't even be anything unethical about it. In Florida, employment is "at-will," meaning that either the employer or employee can terminate employment at any time without reason and without notice unless there is a contract in place.
