Legal Question in Employment Law in Florida

Copy of personnel file and Reason for Termination in writing

I live in FL and was recently fired for reasons I feel were unfair. I was never ''written up'' nor did I have any ''warnings'' of being fired. I have been trying to get a copy of my personnel file, as well as a written statement as to why I was fired. The personnel manager claims I have no legal right to either of my requests. Any ideas as to which Florida Statute might cover this area? Thank you!

Re: Copy of personnel file and Reason for Termination in writing

In Florida, unless yo have a contract to the contrary, you are not entitled to a warning or to be "written up" or to any explanation to why they are firing you -- either in writing or otherwise. There are no statutes that apply.

You are not entitled to your personnel file unless you sue. Keep in mind Florida is an at-will employment state. Unless you were discriminated against, it is tough to file any employment claim. Unfair isn't enough.
