Legal Question in Employment Law in Florida

Employee Liability

My question is in regards to whether or not an employee is liable for a mistake that happens during company time. For example, if a painter for a company spills material on carpet in an office he is working in, does he personally need to replace the carpet or is the company responsible for their employees actions? Please respond with as much information as you can. Thank you for your assistance.

Re: Employee Liability

There is no clear answer on this type of question but my best advice and recommendation is: no, the ee should not pay. Even if it is the ee's mistake, it is my opinion that the Employer is responsible. However, if your employer wants to fire you over this, they legally can do so, such that, if you would prefer to pay for the item at issue and hope they will continue to employ you, that might be better than not paying and having to find a new job.
