I am in the State of Florida. I work for a very large communication co. On short term disablity they use up your FMLA hours first then your short term disablity benefits. if you have an operation and are out for 3 months, you come back with no FMLA for Dr. appt or Physical therapy. Is that common? also, is you boss able to question yourFMLA with FMLA?

FMLA provides for 12 weeks of job protected leave every 12 months (or year depending on how your employer administers the leave). When it is used up, it is gone and there is no rule that portions must be saved for doctors appointments or therapy. An employer may ask for proof that you have a serious medical condition which entitles you to FMLA leave, but should keep this information confidential.
