Can my job terminate me because I want to go on unpaid maternity leave But don't have the 12 months with them?

You are saying they are firing you because you don't qualify for FMLA? I would say that no they can't fire you because you are pregnant and want to go on leave. How many employees are with the employer? Feel free to call or email to discuss further.
