Legal Question in Employment Law in Florida

unauthorized employer payroll deductions

My husbands employer decided, with no proof that my husband was responsible for some repairs to the truck that he drives on the job. He told my husband the repairs would cost 600.00 dollars, when my husband refused to pay he was fired. Now his employer has deducted the money from his last two paychecks without a court order or my husbands authorization. My husband never had any agreement with his employer regarding my husbands responsibility for damages or maintanence of this semi-truck. Do we have grounds for small claims court to recover the 600.00.

Re: unauthorized employer payroll deductions

You can certainly attempt to pursue a small claims action, namely for "conversion" of your husband's wages, however, you will likely have to prove that HE DID NOT cause the damages at issue.
