Legal Question in Employment Law in Florida

I have worked at a hospital for the last 2 yrs at an enrty level position, I have 2 positions at this hospital (transporter & Radiology Tech Assistant). I want to further my carreer at the hsptl as a Radiology Technologist. I am a certifed Radiology Tech since 2011. In 2012 I was hired as a transporter my boss told me she will get me on as a tech as soon as a position becomes available. Every time a postion becomes available I am always denied the job, the reason I get is because they wanted to hire someone with more experience. When I see the people they hire they are new grads (students) that I have watched do their clinical rotations at the hospital, this has happened 4 times now. I also have done my clinical rotations at this hsptl when I was a student, and did very well. During my annual evaluation my boss tells me I perform above and beyond what is expected of me and when I ask then why have I not gotten the promotion to tech she tells me she will get back with me and nothing ever happens. In this department there is close to 40 people 2 of which are male and 2 minorites. (1 wht male, 1 blk male, 1 blk female) Those people were hired before my boss took over. I feel that I am being discriminated sexualy/racially what course of action can I take.

Dear Sir/Madam:

From what you are telling me you might be a victim of discrimination. I tend to agree with your assessment of the situation and I clearly see you are being passed for promotion. However, from the limited amount of information I cannot determine the strength of your claim. I would need to obtain your evaluations, and the characteristics of the other members of the staff to determine whether it was in fact a discrimination issue, preference, qualifications, and/or otherwise.

You might have a good case against your employer.

You should seek the services of a competent attorney who on more thorough examination can determine the strength of your claim.
