Legal Question in Landlord & Tenant Law in Florida

how to evict a house guest

A friend came to visit and ask to stay for 2 weeks with his 2 dogs. He said would have a new job and would be renting an apartment. 2 weeks went by and he did not leave. His excuse cannot find a place with dogs. Gave him 2 more weeks and he has not left. No rent is being paid as he is not a tenant or on the lease. Now he has been in my home for a month and half. I told him he has one week to leave or I will put his baggage outside with his dogs. He then said has no place to go until he makes money on his real estate commissions. Meantime, my utility bills are sky high and the dogs are ruining my carpets. How can I get rid of him?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Unfortunately, your only recourse is to file an eviction action. You start by providing the guest with a statutory 3 day notice to pay rent or vacate. If the friend fails to vacate, then you have file with the court and serve the friend with a complaint for eviction.
