Legal Question in Personal Injury in Florida

Right to make a claim of a mother's deceased's prior claim

Does a daughter have the right to continue personal injury slip and fall case which was pending at the time of her mother's death, and recover monies as part of an estate? Mother's death was not related to the fall. Daughter is married, does not reside with mother, and is not financiallly dependent on mother, or vice versa.

Only the appointed personal representative of the estate can pursue the claim. Speak with the attorney who was representing your mother. Good luck.
