Physicial Attack

While parking his truck at a local lounge, my boyfriend had a fender bender with another vehicle. Three men exited the lounge and one exclaimed, ''you hit my car'' and, ''have you got any money?'' He then punched my boyfriend and broke his jaw in two places. My boyfriend left the scene without his assailants tag number and did not file a police report until he got out of the hospital. His jaw is wired shut for five weeks. His auto insurance covers 80% up to $10,000. Does the property owner share any liability for this assult under their commercial general liability policy?

The property owner may have some exposure under a theory of negligent security of the premises. Seek the advice of counsel and good luck.

The lounge and/or the property owner maybe legally liable if they were negligent in regards to the security for the parking lot. This is by no means a sure bet. However, depending on the specific facts, it might be worth having an attorney look into.

Has anyone been charged? If so, have your boyfriend make the D.A. aware that he wants the court to order restitution.
