Legal Question in Personal Injury in Florida

My son was involved in a car crash that was his fault since he rearended another car. However, the car in front of him stopped suddenly to avoid hitting a drunk guy in the road that could not pick up his scooter which he had fallen off of. Do we have any legal recourse with the drunk person that was standing in the road who caused the accident? If a chair fell out of my truck onto the roadway and caused a crash, I know that I would be responsible for it. Thanks.

Yes, you can sue the drunk. You are still liable to the car you son hit as the law is that you should keep a safe distance, not follow to closely and be able to stop if the car in front stops.
