Legal Question in Real Estate Law in Florida

Not accepting payments

I am buying out my exhusbands share of some free and clear property. I sent last months payment to him on 6/29/01 but he has not cashed the check yet. He tried to foreclose on me once before but I proved to the judge that I was two months ahead on my payments and it was thrown out. I am afraid this is what he is trying to do again. How can I protect myself? I thought about sending the payments by registered mail but that would not prove there was a check enclosed. I cannot afford to keep hiring a lawyer as I had to before. Please Email me at [email protected] Thank you.

Re: Not accepting payments

Send your payments certifid mail.If he tries to foreclose, you should have your attorney file a motion to have your legal fees charged against him..it may not be too late to do that even now. A better idea is to go to a lender and if you can, pay him off and get the jerk out of your life.
