Legal Question in Real Estate Law in Florida

I have a friend who has been paying a mortgage payment to the owner/seller of a house for aprox. 20 yrs. The mortagae payment includes taxes, interest, insurance and principle. A recent hurricane caused a large tree to fall on the house and damage the roof. the owner/seller let the insurance policy lapse about a year and a half ago. what are my friends options if any??? he has an action against the seller who was receiving those funds as a fiduciary. hire an attorney to assist with this claim.
