Legal Question in Real Estate Law in Florida

The Home Owners Association Lawyer filed a lien against my mother's condo on July 23. Can I (daughter) pay off the lien amount to stop the foreclosure process or do I really need a lawyer to do that? My mom is sick and emotionally distress and I just want to pay this off.

You can pay it off without a lawyer BUT you need to ask for a payoff amount. If you do not pay the amount stated as owed, the attorney will apply your payment first to interest, then to late fees (if any) then to attorneys fees and costs, and finally to the assessments owed. Therefore, if you don't pay the full amount stated as owed, there will be a balance owed on the assessments and the HOA can foreclose on that.

Sorry I see it is a condo not an HOA. The answer on this issue is the same.
