Legal Question in Real Estate Law in Florida

My niece and I both put money in a home which was held in her husband's name. They recently sold the property and kept the money. What recourse do I have?

If it was your money and it was not a gift, then you are entitled to have it returned. However, you may have some difficulty proving your loss given the circumstances you described. The recourse would be to threaten or file a civil suit over the money.

The lawsuit would be to impose a constructive trust or for unjust enrichment against BOTH your niece and her husband. These can be costly ventures. You dont mention how much money you put in the home or what the complete terms of your deal were. You should discuss this witha competent attorney as soon as possible.
