Legal Question in Real Estate Law in Florida

I have a pre construction contract on a condo building in Miami. The estimated outside completion date is December 2011. However, the contract also states the completion date is a good faith estimate and the seller makes no promises or representations concerning the date of completion. The developer has not started constuction and clearly will not make the estimated competion date. Further in the contract it states that the closing date shall in no event be scheduled later than (1) year following the outside date.

The developer has refused to return the deposit. Do I have any legal action based on the above information?

Depends... Why do you believe that it will not be completed by December 2011? I have seen buildings go up in under three months in some locations.
