Legal Question in Real Estate Law in Florida

Recently I traded a home in Costa Rica for a condo in North Miami Beach, Florida This trade was all done while i resided in Arizona After the close of both escrows I went to Florida to view the condo. I was told I was supposed to have made residency application before the transfer which wasn't done. While in florida I went to the management company to fill out the papers for residency approval. I was informed it was not necessare since i didn't live in the condo nor have any intention to live in the condo or Florida. I have since made application for residency knowing I will never live in the condo. Application is in process. With my condo came an assigned exclusive use for my unit only of a 40' dock space. Now they are telling me that since I didn't make application for residency before the trade the exclusive dock assignment is extinguished. Is this true and do I need an Attorney.

Generally, an owner must apply to the Condo Board before they buy. Your attorney should have advised you of this. The Condo Board may be using this over your head to obtain your dock space. Without reading the Condo Docs. no one can give you a definite answer.

I'm sorry to hear about your situation. You really should consult with an attorney, who will have to read your condominium association's governing documents. I am board certified in civil trial law, which means that I am an expert in handling civil trial matters. This area includes condominium association litigation. We offer a free initial consultation, and would be happy to speak to you about the situation.
