Legal Question in Real Estate Law in Florida

Trying to recoupe monies from a part owner.

I recently saved my grandmothers house from forclosure. In exchange for paying off the property as well as back taxes, my mother signed over her half of the property. What if anything does my aunt owe me for her half of the property. She has not paid utilities, mortgage or taxes in well over 5 years.

Re: Trying to recoupe monies from a part owner.

While each circumstance is different, you may want to explore how much money your mother and aunt each put into the property for taxes, insurance premiums, improvements and towards paying the mortgage (and other expenses). If someone is not pulling up his/her own weight, you may want to consider taking some legal action to sell the property and divide the proceeds (partition) or to buy out the other person.

If the property is in South Florida, please feel free to call or email me with any specific questions or concerns.

Please understand that the above does not constitute legal advice nor the formation of an attorney-client relationship.
