I am on the mortgage for a residential property. My ex-boyfriend and I are on the title. He is the care taker of the property, collects the rent from the tenents and sends it to the loan company. He is now pocketing the rent money and not sending it in and I am receiving the collection calls. I do not know about the renters and just got on the mortgage to help him. Please let me know if I have any legal recourse against him. He has stated he is purposely trying to ruin my credit and force a foreclosure.

RESPONSE: It's an unfortuante situation but your lawsuit would be for "contribution" in that he would need to pay his fair share based on ownership or the martgage and promissory note that he signed. You may also file a lawsuit for partition, and have the court force a sale and apportion the proceeds to you both in relationship to your proportionate shares in the property.
