Legal Question in Real Estate Law in Florida

rights in a partition action in florida

I have been seperated from my ex-fiancee for about 2 years. We both own the home I am living in with my 3 children. She has moved to a different city. I have tried to work with her to sell the home but she refuses. Mainly because it would be a short sale to the 2nd lein holder for about 80K. I have struggled for 2 years keeping up all the payments and property and just can't do it any longer. What are my rights?

You will need to start a partition action and have the court order a sale.

Mr. Slater is accurate. Your "rights" are limited by the other co-owner.
