Legal Question in Real Estate Law in Florida

I started an eviction on tenants in Pinellas County, Florida. The case was contested by the tenants and a court registry was set up for rent payments. Before the hearing date I had to report for duty in a new location (military). The rent is paid up to date and I am happy with the tenants, so I cancelled the hearing. Now, I have two months of rent sitting in the court registry and Im not sure what forms to fill out to dismiss the eviction and collect the money from the court registry,( Im stationed 1100 miles away from Florida now). Thanks.

Based on the information you have provided, there should have been a judge assigned to your case. As such, I would recommend you write a letter to him or her explaining your circumstances and requesting a order filed that the case be dimissed and the funds held in the registry of the court be released to you. Also be sure to make note that you have allowed the tenants to remain. Be sure to send a copy of the letter to the tenants as well. Best wishes on closing out your case and God Bless.

Contact the court in writing, as suggested above, or hire an attorney to help you recover your funds. Best regards,
