Legal Question in Traffic Law in Florida

I had an intoxicated homeless person run in front of my car not in a designated crossing area and I hit him and injured him. I rec. a failure to yeild to a pedestsrian with serious injury. Neither the transient I hit nor the transient witness would come to court and after the first hearing they were absent the judge set for a status hearing in 30 days to try and find them. He stated on record if they were not found within the 30 days the ticket would be dismissed. It is three status hearings later no witnesses the officer did not see anything and the judge is trying to get me to plea to same ticket but drop bodily harm. I have already paid a lawer a grand to this point. How can he (the judge) go against what he stated on record???
