Legal Question in Wills and Trusts in Florida

beneficiary of deceased father

My daughter who is an adult just found out her paternal grandmother passed away. She also found out their was a will stating her father was left 5000.00. Her father has been deseased for about 12 or more years. We were never married, but he signed her birth certificate. His mother never updated the will. Is my daughter entitled to his share being the only child he ever had. I heard the family is protesting because I broke off contact with them.

Re: beneficiary of deceased father

It depends on the way the will was drafted. The gift might have lapsed because the father predeceased the grandmother. Or, if the gift was "per stirpes," for instance, your daughter takes her father's share. It truly depends on what the will says. You should have an attorney take a look at the document.
