Legal Question in Wills and Trusts in Florida

My father passed away and had a savings account with my mother as beneficiary but she has also passed. There is a trust with the kids as beneficiaries but this account is not in it. Now I understand it has to go to Florida probate. Does the State then take a portion?

No. The bank will not permit a withdrawal without a personal representative of the estate being appointed via probate.
