The question I have of you is, how was the benefit denied? Was it by the insurance company or the employer? If so, a petition for benefits must be filed within 2 years of the accident causing the death. If you have had a hearing on a peititon before a Judge of Compensaiton Claims and an order was entered denying the claim for death benefits, there is a thirty day period of time from the date the order was entered to file an appeal to the 1st. District Court of Appeal. The papers for an appeal are filed with the JCC. If you miss the 30 days, you are out of luck.
