Legal Question in Consumer Law in Georgia

Lease Vehicle

The salesman was a fast talker and did not answer our questions about the buyout price on our lease or the excess mileage that we were supposed to pay. We signed paper to get another car financed but now see that this is not the right decision. Our leased vehicle was turned in on late Friday evening and the first thing Monday, we notified the dealer that we wanted to purchase our leased vehicle. But now they say we can't, its too late. Our lease agreement had an option to purchase included. We intended to pay cash for the leased vehicle. They are trying to stick us with this other vehicle that we do not want. We have never received a check from the financing company and since our leased vehicle was over the mileage, now they want 7,000 for excess mileage. What can I do?

Re: Lease Vehicle

Your post is far from clear and jumbles the issues, but the bottom line is that your question about what you can do is almost always going to be found in the contracts you agreed to when you signed them. If that includes excess mileage charges (as most leases do), then you likely have to pay. If you signed a contract to purchase another car, it will likely mean you have purchaed that car. Read the contracts. "Fast talking salesmen" or "I made a mistake" do not invalidate contracts (absent a provision saying so).

Re: Lease Vehicle

You are responsible to read and understand what you sign, and once you sign a contract, "he was a fast talking salesmen" or "I made a mistake" or "I changed my mind" are not defenses. In other words, you have to live with the agreements you made. Since we have not read them, we do not know the detailed terms, but you will need to abide by the written terms.

The answer to your rights will be found in the documents. From what you have stated, it is impossible to advise you. Consult with a local attorney who will review the documents.
