Legal Question in Credit and Debt Law in Georgia

I returned from my reserve billet on November 04th. I was gone for 4 weeks. When I returned my employer stated there was no more work for me, however reported to Department of labor that I quit. They falsely stated the facts and I have informed them prior to my going, during my orders, as well as once I returned I was back. My unemployment had not been paid and my car is to be re-poses if I don't provide $900 cash by the 30th and at least a payment of $380 by the 20th. I am in need of legal council with no job and soon to be no ride. I signed with this company a contract that in case I lost my job through no fault of my own, my debt would be held, however its been at least Since August that I have not been paid enough finance to cover all bills. Could I get some help please! I have an offer for employment which I accepted.

I don't know what you need help with. Sounds like you have several areas - (1) employment. I don't practice in this area but if you are covered by the Soldiers' & Sailors' Relief Act (SSRA), then maybe you have a claim. (2) car repo - ditto for this. The SSRA provides restrictions on what a creditor can do if you are deployed.

On the car, well, it cannot be repo'd if the lender cannot find it. If you are that close to getting some income, I would hide the car. Either that or file for bankruptcy if you have other debts. If nothing else, the bankruptcy would prevent a repo. If your are not keen on the bankruptcy, then come up with enough to prevent the repo. Once the car is gone, it will be difficult to impossible to get it back without filing bankruptcy. You need to consult with your JAG officer (or the equivalent if you are in the state national guard) about your rights. If you are protected under the SSRA, maybe you can argue that. However, I would deliver pizzas or do whatever you have to do to get that $380 and prevent repo.
