Legal Question in Criminal Law in Georgia

My boyfriend of 7 years was arrested in 2004 in Georgia on 2 counts of trafficking meth. The arresting officer not only knew my boyfriend very well but was related at onetime. They have never been on good terms and have had several run ins with each other. The charges were dropped b/c they decided not to take it to court. In 2009 the arresting Officer became magistrate judge. A search warrant was served for our house and we wasnt home when they searched it. The search warrant was signed by the same officer/Judge. Almost 2 months later they show up with a arrest warrant, kicked the door in and is trying to charge him with trafficking Meth and they never found anything on him. His court date is 01/25/2010 is there anything you can do or tell us that might help us. Please its not right!
