Legal Question in Criminal Law in Georgia

Criminal Trespassing

My boyfriend was arrested for criminal trespassing in Atlanta for not leaving a bar when asked by a bouncer. His case is held in municipal court right now. What is the worst case scenario for this? What if it goes to State Court? Is there a way to plea bargain this down to Disorderly Conduct?

Re: Criminal Trespassing

Your assumptions are correct. It is readily possible to work out a plea in Municipal Court barring any aggravated behavior in the underlying offense, e.g. an angry arresting officer or victim. I would strongly recommend that you dispose of this case prior to any bind over to State Court and do it as an ordinance violation. The presence of an attorney in court may enhance your chances of gettting this done, but you can try to handle it pro se if you wish.
