Legal Question in Criminal Law in Georgia

expungement

Can an arrest be expungement off my record. The crimnal solicitation charge was dismissed, the dc/occupying charge misdemeanor, I paid $100.00 fine...however, I was never guility of either crime. I was simply passenger in the car. I was given a ride home and did not know he was going to purchase marijuana. The purchase was made by my brother that would not own up to the charge at the time of the arrest. I tried to tell the policemen but he would not listen. At this time, I am not able to get a job because of this mess on my record. Can I present new information that in fact he is guilty. He has now ready to admit to the charge. I tried to get this expunged off but it in fact was deined. The arrest happened to Oct 4, 1985. Please Help....

The expungement statute is actually narrowly drafted. There may be an alternative way of accomplishing what you are seeking. Were you represented by counsel on this old matter? Do you have any other record of misconduct? What County dealt with this old matter?
