Legal Question in Family Law in Georgia

Ok my son and I are citizens in valdosta, ga and have been visiting my dad in nj for the past 3 months and I have been told now that if I dont decide to leave my son up here with my dad and his wife then they arent gonna send us back and they are going to take me to court to get custody of my son. Can they do that?

Why is it necessary for your father and his wife being the persons to "send you back"? I assume you are an adult and can leave and return to Valdosta at any time with your son. If I were you I would do so. I have no idea from your posting why they even feel they would have the right to get custody. If you return to GA and reside in GA, they have to file here. You may need to consult an attorney in NJ if you decide to stay.

You can come back to GA if you wish but hire an attorney wherever you decide to stay

Your parents have no say in child's custofy unless you left out important information
