My ex has is taking me to court for custody. Do i have to let him talk to our daughter?

We have no way to know. What does your custody order say and why did you fail to tell us. (If you violate the custody order you can be jailed for contempt and risk losing custody). And why have you not called your lawyer? The best way to lose a child in a custody case is to fail to hire a lawyer on day one.

If the order states the father has telephone access then yes, you have to let him talk to your daughter. If it doesn't state that and yet he has had telephone access in the past, the Judge could certainly frown on you prohibiting contact. You have failed to provide sufficient information to provide an adequate response. I suggest you immediately obtain the services of an attorney rather than posting questions on a website.
