Legal Question in Family Law in Georgia

My wife moved out of state with my daughter. I have not seen her months. Is there any legal action I can take. I am currently saving for a lawyer to file for divorce.

You're missing an opportunity to save money by waiting. For the 1st six months after she moves, you can file in Georgia and compel her to defend the custody issue here. By waiting you will not be able to file in Georgia, will have to file where she is and will add the expense of traveling back and forth. In other words, treat this as a legal emergency and call lawyers today.

When you say months, hopefully it is not more than 6. Georgia retains jurisdiction over a person in a divorce or custody action for 6 months. You have equal rights to your daughter as there is no court order. You need an attorney. If you don't have the money, go ahead and file the divorce to get it started and get jurisdiction over your wife.
