Legal Question in Civil Litigation in Georgia

Someone using my name and address

Yesterday I received a letter from an insurance co. in Brooklyn NY. They claim that I was involved in an accident on 09/01/2000 and would like for me to reimburse them in the amount of 3200. The problem is, I have never been to NY in my life, I do not own a 1984 Chevy (the vehicle involved in accident), and on 09/01/2000, I was moving into a new home that my husband and I just built. How did this insurance company get my name and address from a vehicle that I never had? And is it possible that someone got my name and address somehow and gave it to them at the accident scene? What can I do?

Don't ignore it. I think if you will see an attorney, it looks like a problem that can be cleared up quickly and inexpensively.

My guess is that whoever wrote the letter simply made a mistake. However, the other attorney who posted a reply is correct: You should immediately contact them and offer to prove your identity. If you don't, the sheriff may show up on your doorstep and serve you with a lawsuit. It will be much more difficult and expensive to extricate yourself at that time.
