Legal Question in Civil Litigation in Georgia

Liability

Someone hit my car from the rear which caused minor damage only to my vechicle. We exchanged information but did not call the police. She agreed to pay for the damages. My 15 year daughter was in the car with me and was a witness. I got an estimate and have tried on numerous ocassions to contact this person, but she will not answer nor return my phone calls. Without a police report of the accident, what can I do to get payment to have my car fixed?

Re: Liability

Contact the other driver's insurance company. If you don't have that information, write her and threaten to sue her in small claims court unless she turns the matter over to her insurance company.

Re: Liability

Did you get the driver's insurance information at least? Although you should have called the police, it does not necessarily preclude you from recovering money for car repairs and any other damages. So, contact her insurance company and if necessary take her to small claims court.

Also, you can go through your insurance company and your will pursue any claims for recovery against the driver.
