Legal Question in Civil Litigation in Georgia

traded in car, but cant get financing

When I traded in my old car when I signed a contract and I left the lot with a newer car. Three months later the dealership said they would report the car stolen if we could not get financing. Im 18 so I don't have enough credit, and my parents both have horrible credit. We finally agreed to switch the cars back and they said that the car wasn't there. It has been a month and I'm still driving the newer car. Everytime we go to the dealership to talk to them they are too busy and the car is not there. If they sold the car that they technically do not own and ordered a new title, what kind of trouble would they be in legally? Would they just get in trouble for the trade in value of the car on the contract or would they get in trouble for theft?

The written contract and other papers, if any, will have a lot to do with how your situation is resolved. It is hard to give you a reliable answer without being able to review those documents. Consult with a local attorney.
