Tree Service Company

I hired a tree service company to come out and cut down 5 trees in my yard. They started the job on 02-28-07 and to date have yet to complete. My yard is a mess & the guy keeps dodging my phone calls. I now have to hire someone to not only complete the job but clean up the mess the first one started. Not to mention, he took down my fence and has left his equipment on my property. I am sending him a certified letter today advising I no longer need his services & that he has unitl 5 pm on 03-23-07 to come and get his equipment off my property or I will have it towed at his expense. What legal actions if any do I have against him and him against me? Thanks

You likely have a breach of contract action against the tree service company. You can recover any additional cost that you incurred due to his breach of contract. For example towing his equipment away or having to pay a higher contract price. He could have a breach of contract action against you because you did not let him complete his contract. Get an estimate of the cost to finish what he left undone, an estimate for the towing charge and storage of his stuff, if applicable. Then consider suing him in Small Claims court. Go to the courthouse. They will give you the forms.
