accepting offer from insurance company from auto accident

I was recently involved in a automobile accident that was not my fault. My automobile was totaled. The other drivers insurance has offered me a offer that is not even close to book value. Should I get at least book value for my car? This offer will put me in debt more than I already was with my car. It just does not seem fair that I have to accept an offer that will not even get me in the same exact car that I had. Do I have a leg to stand on if I go after the driver of the other car for like pain and suffering? Myself and my daughter had minor injuries.

You may have to hire an appraiser to even the score. On a damage claim for the car there is now a new law in effect that makes it hazardous for the insurance company to play the same old games. If you were injured you should get a doctor and treat until you are better. It may make all aspects of the case easier to deal with. We would be interested in speaking with you.
