Accident to child at daycare

In june of 2003, a 21 mo. old child in my care fractured her leg when her sibling fell on her while they were dancing. I paid a portion of the bill out of a feeling of responsibility, but now the mother of the child wants me to pay all of the medical bills. The child continued in my daycare until 09-03-03. The mother owes me money for my services, and left without a notice. I also suspect that the child has medicaid. I am certified with the state, I did notify the mother of the incident within 30 minutes, and the incident was reported to the state. What are my rights? Do I pay the medical bills? How do I collect the money owed to me for my services?

Contact your liability insurance carrier. They are obligated to defend you under the policy if you have a defense. Because of the age of the children, however, there may be a question of your liability. If you don't have liability insurance, you could have a big problem, in which case, e-mail me at [email protected]. You could sue for the unpaid bill, but if I were you, I would wait until this injury claim is properly evaluated.
