Legal Question in Personal Injury in Georgia

Myself and my daughter were in a car accident.

Myself and my 19 year old daughter were in a car accident about 7 months ago. My daughter had serious injuries, she was driving I was the passenger, it was my car I had injuries also. The problem is that we were making a left turn and the other driver was traveling straight. He was speeding but because we were making a left turn she was cited. my daughter was in the hospital for a month and the car was totaled, only liability on the car. The insurance company sent a letter that said the accident is going into arbitration. This accident was not our fault and i don't know what I should do. We do not have an attorney. The medical bills alone have reached over $200,000.00

Sounds like it was quite serious for all involved. My questions would be these ... did your daughter fight the traffic citation? Was she found guilty? Innocent? Did the other driver receive a citation? What happened?

What type of arbitration? Has your daughter been sued?

Easy answer - get a lawyer. Ask for referrals of qualified and experienced lawyers, and don't just go to the back of the phone book. With $200,000+ in medical bills, it is not an issue for an internet forum such as this. You'll certainly have some issues overcoming the fact that she turned left into oncoming traffic (speeding or not) and was issued a ticket.

You should retain an attorney. Just because your daughter was cited does not necessarily determine fault. Her turning left is certainly a problem, but it can be handled.

Definitely get an attorney as soon as possible. I have successfully handled several cases similar to your and would be happy to assist you. Much more investigation of your case is needed to help prove the liability of the other driver and that investigation has to start asap after the accident so please hire someone immediately.

Some more information is necessary to give you an accurate evaluation. For instance, did your insurance company already accept liability and pay the other driver's claim? What were the driving conditions? Was the road flat?

You may have a claim against your daughter. It depends on your policy language and whether your daughter was living with you at the time of the accident. Recovering on your claim may help mitigate the overwhelming medical expenses.
